The web site provides access to a number of services that may be used in accordance with these terms. The services include:

The ability to create an online account to manage the selling of your images;
The ability to purchase products and prints via our online shop;
Help, advice and support from us or fellow photographers via the forum
Information on all our printing services
The ability to download our prices or third party software.

These terms govern the relationship between you and us. The web site (and the services provided through the web site) can only be used if you agree to these terms. You may only use the web site in accordance with these terms. Only persons aged eighteen years or over may agree to these terms and use the web site or the services offered through the web site. We may modify these terms at any time. We will post the modified terms on the web site. We will notify you by email if we do so. The modified terms will come into effect as soon as they are posted on the web site and use of the web site (or of any services provided through the web site) after that point will be subject to the modified terms.

YOUR ACCOUNT

You may open an account with us by completing the Registration Form . Once your registration has been completed (and until your account is terminated) you will be allowed (subject to the restrictions contained in these terms) access to other areas on the site including the shop and help pages and once your registration has been approved by us (not normally taking longer than 48 Hours) you will receive full access to the web site and all our services. (subject to agreeing to any additional terms applying to them).

You will have to provide your email address in order to open an account. Your email address will help us to verify your identity on future visits. In the event that you register using a non-existent email address or an email address that belongs to someone else, We may terminate your account without notice. You will need to provide a password by which, in combination with your email address can be used to sign in to your account for full access to the web site.

There is no charge for opening a myschoolpictures account.

There may be charges for other services supplied by us. These will be notified to you at the time you request the services. When you place an order for goods or services (including printing services), you will need to give your credit card number. Any charges for the services requested will be billed to your credit card once the order has been accepted.

In the event that you give details of a non-existent credit card number or the number of a credit card that belongs to someone else, we reserve the right to terminate your account without notice.

MONTHLY SUBSCRIPTION

If you have chosen to subsribe to our online ordering service then you agree to a £50+vat per month subsciption charge for the online ordering service to be deducted each month from the total due to you by us for all products sold via www.myschoolpictures.co.uk. This charge will only be made if you are due from us an amount equal to or above this amount at the end of each month. If you are due less than this on any given month then we will make a charge equal to the amount that you are due from us and you will not be due any monies from us for that particular month.

MAKING A PURCHASE

We accept Visa, Mastercard, Switch, Delta and Maestro. Offer codes may be published from time to time as part of a promotion. Offer codes may provide a discount on part of or the whole of an order. Offer codes can only be used for online orders placed through this web site. A maximum of one offer code can be specified per order. Unless otherwise specified, postage and packing charges will still apply to orders subject to an offer code. Further conditions may apply and if so will be published with the relevant offer code.

IMAGES

Once you have created an account, we will issue you with an FTP username and password that you can use to upload image files directly to our server. All images you upload to us in JPEG format and the sRGB colour space. Each file must be compressed down to be less than 2MB in size but must open up to be at least 10MB in size. We will then create thumbnail images for the purpose of identification for parents on www.myschoolpictures.co.uk.You are not allowed to upload or email to us any images or other material which contain:

nudity or pornographic or obscene material; racist material; material that is likely to incite hatred against any person or group; blasphemous material; defamatory or otherwise actionable material; images of any criminal act; material the use or inclusion of which infringes any copyright, trademark or other intellectual property right of any third party; material that breaches any applicable laws or legislation

You are advised to keep back ups of all material provided to us. In particular, it is up to you to keep backup copies of images uploaded by you. We will not be responsible for keeping backups or for loss of, deletion or corruption of any images or any other material.

RIGHTS

OPERATION OF THE WEBSITE

We may change the format and content of the web site (or any products or services offered by this web site) at any time. We may terminate or suspend the operation of this web site (or terminate or suspend provision of any products or services offered via this web site) for support or maintenance work, in order to update the content or for any other reason. We may do this at any time and without notice.

DATA PROTECTION

Personal data provided to us through this web site will only be used in accordance with our privacy policy . Please read through this carefully before proceeding. By providing your personal data to us you are consenting to its use in accordance with our privacy policy .

TERMINATION

You may terminate your account by contacting us via email or post. You may be asked to provide further proof that you are the holder of the account. Your account will be terminated as soon as reasonably practicable following receipt of your email or letter. We may terminate your account without notice at our sole discretion. Once your account is terminated, your images will be removed from the web site and your password will no longer enable access to the password protected areas of the site.

POSTAGE & PACKING

The shopping basket will automatically work out the correct postage for your order based on the combined weight of the items you have added to the basket up to a maximum of £9.95*. FREE P&P* will apply on all orders totaling £200 or above.

DELIVERY

For courier deliveries, we aim to despatch all orders placed before 12pm the same day. Orders placed after 12pm may not be sent until the next working day. Royal mail deliveries normally take 2-4 working days but may take longer depending on your area and the time of year.

Please put any additional delivery instructions in the "SPECIAL INSTRUCTIONS" box at time of placing order.

NOTE: We are charged £4 for each unsuccessful attempt to deliver your order by our courier. We must pass this charge on to you the customer. If your order has been classed as a failed delivery we can either re-send the order (at your cost) or issue a refund (for goods only less all shipping costs). For orders sent by Royal Mail there is no charge raised for the return, where appropriate the customer is still responsible for the shipping charge to re-send.

TAX CHARGES

All prices shown on the page content of this website are exclusive of vat. When you add a product to the shopping basket, prices shown will be inclusive of VAT at the current rate of 17.5%. Upon completion of a successful order you will automatically receive a VAT receipt.

SECURITY

You must keep your password secure at all times. You will be responsible for any damage caused by unauthorised access resulting from your failure to keep your password secure. We know of no documented cases of credit card fraud using our shopping system over the Internet. All credit card payments are taken securely by Protx. Protx has achieved the highest level of compliance under the Payment Card Industry Data Security Standard (PCI). RETURNS POLICY

In the unlikely event that you have to return any products to us you should be aware of the following.

Please email info@myschoolpictures.co.uk with any problems. This helps us both have a record of events. We always answer emails in the order they are received and as soon as practically possible. DO NOT TELEPHONE US. Our staff who answer the telephone will be unlikely to be able to help as they are mainly trained in other areas of the business. You will get a much quicker and more informed response if you email info@myschoolpictures.co.uk

Cancelling an Order

You have the right to cancel the contract for your purchase(excluding any photos that have been printed at your request) within 7 working days of delivery. You do not need to give us any reason for cancelling your contract, nor will you have to pay any penalty. You can only cancel your order if all the goods you have ordered are still unopened and in their original sealed packages in which they were delivered to you.

To cancel a contract, write "Cancel Contract" on letter-headed paper. Package the items securely and send them to us within 7 working days of the date that the items were delivered. We request that you email us at info@myschoolpictures.co.uk to tell us that you are returning goods before you send them. 24 hours' advance warning is required for returns. The return address is:

We recommend that you use a recorded-delivery service. Note that you will be responsible for the costs of returning the goods to us unless we delivered the item(s) to you in error. You should be aware that once we begin ro process your order, you will not be able to cancel any contract you have with us for services carried out by us (for example, design work or postage and packing). When we receive the goods with the notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item.

Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account (minus a 20% re-stocking fee) as soon as possible and in any event within 30 days of your order, provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you

Damaged Goods

You should inspect the goods when you receive them for any damage. If the package you receive looks like it may be damaged or has been tampered with you should refuse the package or mark the courier's sheet to show this (if you do sign to accept the package). If the goods are found to be damaged prior to delivery to you then we will replace or refund the price paid. If you find any damages you must inform us by email within 24hrs (preferably immediately on the same day you receive them). We cannot be held responsible for damages reported after 24hrs of receipt.

Note: For your protection, we recommend that you obtain a certificate of posting when returning your order. (available from the post office at time of posting)

Your statutory rights are not affected

Remittance Terms: All goods remain the property of JP Photographic Ltd until paid for in full.
